This agreement is between you (named above)-- referred to as "client" or "you" & Tattered Lens Photography/ Savannah Benz--referred to as "me", "I" or "photographer(s)".
[ You can expect your engagement shoot to last anywhere from 60-90 minutes, I encourage outfit changes and have included that in the time allotted. I typically deliver anywhere from 50-150 images of an engagement session. If you choose a location further than an hour away, please be considerate and understanding in my expectation that you cover any travel cost. I am more than willing to meet at an agreed upon local area and drive with you and your fiancé to your desired location. You can expect a gallery of 300-500+ photos for your day; mind you the longer you hire me for, the more photos you can expect. For example, I cannot promise 500+ photos of a courthouse elopement that lasts an hour. I can however, promise a gallery of 500+ photos if you have getting ready, first look, ceremony, cocktail hour, first dances, sparkler exit, etc.—Not saying you must have all these things during your day; the idea is the more events you have, the more I have to shoot. I give you what you give me. There is no maximum limit to the number of images I deliver. Having a second shooter will also give you more images, together we average between 60-80 photos per hour. ]

I. Booking Fee/Deposit: The booking fee of $1,000.00 is due within thirty (30) days from booking date. Otherwise, a percentage of the total amount will be considered to be a form of deposit.
a. The booking fee/deposit will go toward the full agreed upon amount.
II. Additional hours: foreseen or not, additional hours will be charged as I (the photographer) see fit. If your package is for one photographer, it is $150/additional hour. For two photographers, it is $250/additional hour. This additional charge will be sent to the you (the client) in the form of a formal invoice, a payment request the via last used platform for payment method i.e., Venmo, Zelle, etc.
III. Cancellation: In the event of the clients (you) cancelling the wedding for whatever reason after 7 (seven) days of contract completion, within your control or otherwise, all fees & payments are non-refundable & the amount agreed upon (see above section, "package/ pricing") is still due entirely.
a. If your event is cancelled due to an unforeseen circumstance, there is a contractual obligation of Force Majeure. Definition: "unforeseeable circumstances that prevent someone from fulfilling a contract." This will only be taken into effect if this occurs on the exact time & date of your booked event.
b. Should such event occur on your event date implementing Force Majeure, all payments made are non-refundable. I (the photographer) will take into consideration the possibility of coordinating other ways to still photograph you (the clients) at a later time, i.e., a lifestyle shoot or something similar.
c. If you neglect to pay the agreed amount after cancellation, I (the photographer) agree contact you to attempt to collect payment or schedule payment arrangement three times within 30 (thirty) days after booked event date. After 90 (ninety) days past booked event date, if payment is still not made or arranged I will send your account to a collection agency or a claims court. See "Legal" section of contract.
IV. Rescheduling: The clients (you) are responsible for communicating with me (the photographer) about rescheduling your event & choosing a new event date.
a. I (the photographer) will not cancel or double-book any previous obligations made to photograph your rescheduled event.
b. I will not refund any portion of amount agreed if you do not choose a date in accordance to my current openings.
c. Travel fees may apply for the rescheduled event's location.
d. I will not downgrade package pricing. The original amount agreed upon is still due entirely even if you downgrade packages. Your package itself may be downgraded, i.e., hours of coverage, number of shooters & whether or not an engagement session will be included, but you will be responsible for the original amount due & stated in above. A revision will be made to the contract & you (the client) will be sent a copy.
e. If you would like to upgrade packages, I (the photographer) will ask that you complete a new contract & a cancellation contract regarding the original, making it null & void.
f. You (the client) may reschedule your event date once at no charge, each additional date change after 7 days from contract revision will result in a $500 fee. This is added on to your full amount due & is also to be paid in full prior to your date.
g. Should you decline to reschedule event, see cancellation portion of contract.
V. Legal: Should our relationship take a turn for the worst case scenario possible; if I (the photographer) am forced to take action & seek legal representation, you (the client) are responsible for all fees pertaining to my representation. I will not seek legal representation unless:
a. you (the client) present me with your own legal representation in an effort to forcefully break, revise or become exempt from this contract.
b. your account becomes delinquent & I (the photographer) have to take your account to a collection agency or a claims court.

I. Payment arrangement: I am flexible on the payment schedule if the full agreed upon amount is paid prior to your event date.
a. I do not accept cash payment.
b. I do accept checks.
c. I have APPS (i.e., Venmo & Zelle ) that allow payment without any transfer fees.
d. If you use PayPal or any other credit card service, you are responsible for the transfer fees.
II. Meal/ break: The clients agree to provide a meal & small break time for the photographer(s) if the length of attendance exceeds five hours.
III. Confirmation: A signed contract for wedding photography services and payment of some kind is necessary to confirm the stated wedding services from the photographer(s).
IV. Pre-Wedding Consultation: This normally happens within a month of the event date. The clients will outline broadly what is required and the photographer will advise on planning, logistics and timings where needed.
V. Cooperation: The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract.
a. The Clients agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare e.g. bouquet throwing, cutting the cake, speeches etc.
b. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his/her discretion but cannot be held responsible for a lack of photos of these people.
V. Paparazzi Wedding Guests: All of your guests will have digital cameras or camera phones and will want to photograph you. In the spirit of cheerful cooperation, the clients agree to give the photographers precedence over the guests to take the photographs required for the wedding services described above.
a. I cannot be held liable for a lack of wedding photos if guests taking their own photos of the clients continually interrupt the photographer's work.
b. We don’t want to hurt anyone’s feelings if/when we must remind them that we are professionals & were paid to do this job. We have no problem asking someone to refrain from using their device if it compromises the shot & reserve the right to do so.
c. You (the client) agree to not hire another photographer to shoot along side me. I (the photographer) am responsible for sub-contracting a second photographer if your package calls for one.
d. Videography is exempt from above statement, but is not able to take still photographs. You (the client) are responsible for relaying this instruction to your videographer.
VI. House Rules: Note the Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. In such circumstances, the clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned.
VII. Copyright Law: The copyright of photographs remains with the photographer until you are paid in full. The photographer grants the clients permission to make copies of the images under the following conditions;
a. The images taken by the photographer are for personal use by the clients and their friends and relatives.
b. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from the photographer.
c. Sharing from a social media platform after adding a “filter” or adjusting in any way is not permitted.
d. After you are given all printing and copyrights to your photos; you agree that I can use your photos for marketing (i.e., on social media and any websites associating Tattered Lens Photography.).
e. This part is also considered to be a “model release”.
VIII. Gallery delivery: Your gallery (images) will be delivered via an online forum approximately ninety (90) days after your event date.
a. I (the photographer) agree to open communication if post-processing takes longer than the ninety days.
b. You will have the access to download all files.
c. If your package does not include prints, this contract is considered your print release if you choose to have your photos printed through a third party. I am not liable for the quality of printing.
d. The site will automatically delete your gallery after thirty (30) days after being posted.
e. I am not responsible for keeping your gallery for longer than seven (7) days, in my own personal files. Within that time, you have the right to request a photo that might not have been included (which is my responsibility to make that decision) be sent to you. Should this happen, I will edit said image(s) & deliver them to you via e mail (if there are under 10 images) or via a separate online gallery (for 10+).
IX. Damaged Equipment: If something were to happen to The Photographer’s equipment, The Client(s) take full responsibility of reimbursing for cost of damaged item(s). My equipment is very expensive and essential to my livelihood. If a guest of your event is to blame, it remains your responsibility to cover damage costs. I am of course obligated to provide sufficient evidence that it was in fact due to an occurrence at your event and within 72 hours of the event date. If I contact you within the 72 hours and you don’t receive or reply, you are still liable.
X. Limit of Liability: If I (the photographer) become too ill, have pregnancy related complications, am in labor, or otherwise become injured and cannot fulfill the wedding services specified above, I will book you a replacement photographer.
a. Under normal circumstances, a second shooter is there for the day anyway and this photographer will then shoot the day on his/her own.
b. If both photographers are unavailable and a replacement photographer cannot be booked, then liability is limited to a refund of any payments received.
c. The sub-contracted/replacement photographer will be paid by me, you (the client) are not responsible for their compensation.
d. Should you (the client) wish to terminate your contract, see above section "cancellation".
e. There is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. If this situation occurs, I (the photographer) I am not obligated to give a refund but will take it under my own discretion whether or not to do so. Please keep in mind that I am human, and I have taken all the steps within reach to make sure neither of these situations happen but again neither are within my control.
XI. My Safety: I (the photographer) reserve the right to leave your event at any time if I feel my safety is compromised. I will not be held responsible for refunding any payments if my safety is compromised.
We have understood the contents of this contract and agree to the terms therein.
